LA Revised Statute 37:33 – Pre-Application Eligibility Determination
In accordance with LA Revised Statute 37:33, an individual convicted of a crime may request at any time, including before obtaining any required education or training, that an entity issuing licenses to engage in certain fields of work pursuant to state law determine whether the individual’s criminal conviction disqualifies the individual from obtaining a license issued or conferred by the licensing entity. LA Revised Statute 37:33 allows for a pre-application eligibility determination with or without the completion of a criminal background check.
We strongly suggest that Request Option B is used in an effort to assure your determination is valid. An eligibility determination may be voided if at the time a full application for a license is submitted, the applicant has been subsequently convicted of a crime, has pending criminal charges, or has previously undisclosed criminal convictions.
Request Option B – WITH Criminal Background Check (CBC)
An individual requesting a pre-application eligibility determination shall include any identifying information required by the Board and details of the individual’s criminal conviction, including any information relevant to the factors provided in LA Revised Statute 37:2950.
A request for pre-application eligibility determination may be denied should any requested details above not be provided. Furthermore, an eligibility determination may be voided if at the time a full application for a license is submitted, the individual has been subsequently convicted of a crime, has pending criminal charges, or has previously undisclosed criminal convictions. Within forty-five days after receiving a request, the Board will inform the individual whether, based on the criminal record information submitted, the individual is disqualified from receiving or holding the license about which the individual inquired.
You must first submit the request form for pre-application eligibility determination, and ONLY AFTER submitting the form do you complete the steps below to get your background check sent to the Board office.
Completing the Background Check:
The Louisiana Applicant Processing System (LAPS) provides a statewide network of fingerprint sites where applicants can submit digital fingerprints within their local communities.
- Go to the LA Applicant Processing System (LAPS).
- Click on the Click Here > link to view the “Fingerprint Appointment Scheduling Directions.”
- Carefully follow all instructions given by the LA State Police.
The Printed Copy of Right to Review (27N4RK) is the only acceptable document type. DO NOT select the “Emailed Right to Review” as it will NOT be accepted.
IMPORTANT: The Board Office must receive the original hard copy with the stamp raised seal, stating it is a “True Copy” from LSP.
When completing the background check, you may be required to provide additional documentation.
- If you are scheduling an appointment online, no other physical forms will be required to complete the background.
- If you do NOT have an appointment and are a “walk in” then the LSP may ask for additional forms to complete the background check.
Online appointments are strongly recommended.

Criminal history may be used as a basis for denial. All factors outlined in LA Revised Statute 37:2950 shall be considered.
A determination made pursuant to a pre-application eligibility determination is binding upon the Board unless, at the time a full application for a license is submitted, the applicant has been subsequently convicted of a crime, has pending criminal charges, or has previously undisclosed criminal convictions.
